Expressions of Interest Form

The Forks aims to be reflective of our community, informed by census data, in the businesses represented on-site.

You may also attach any other information about your business here. This may include but is not limited to:

  • Proforma statements
  • Marketing plan
  • Images
  • Brand package
  • Promotional materials

By submitting an EOI, you agree to these terms:

Disqualification:

  • EOIs not meeting mandatory requirements or having conflicts of interest may be rejected.
  • Conditional EOIs or those imposing inconsistent terms will not be accepted.
  • FRC may reject any or all EOIs at its sole discretion, and may negotiate, request more info, or waive minor issues.

Award or Rejection:

  • FRC can award the EOI fully or partially, or withdraw it anytime without obligation.
  • Submitting an EOI does not create a contract or obligation to accept.
  • FRC’s decisions are final and not appealable.
  • The Expression of Interest (EOI) process is administered by FRC. While FRC may recommend a particular EOI submission to one or more developers, the final decision regarding acceptance rests solely with the developer. All contractual and lease agreements arising from the EOI will be negotiated directly between the applicant and the developer.
  • No contract shall be deemed to exist unless and until a formal written agreement has been executed by all relevant parties.

Right to Reissue:

  • FRC may reissue the EOI if no suitable proposals are received or if deemed necessary.

Ownership and Costs:

  • All EOIs become FRC’s property and will not be returned.
  • Respondents bear all costs of submitting EOIs.
  • FRC is not responsible for any expenses incurred.

Confidentiality:

  • Information in this EOI and submissions must be kept confidential and only used for this process.
  • Respondents cannot share information without FRC’s written consent.
  • Confidentiality obligations survive beyond this process.

News Releases:

  • No public announcements or media releases about this EOI or related contracts without FRC’s prior written approval.

Multiple Proposals:

  • Respondents can submit multiple proposals but each must be separate and meet requirements.

Amendments:

  • Proposals can be amended or withdrawn before the closing time only.

Committee Decisions:

  • The evaluation committee’s decisions on proposals are final and not subject to appeal.

Governing Law:

  • This EOI is governed by the laws of Winnipeg, Manitoba, and Canada.
